Right of Withdrawal

Consumers have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you or a third party designated by you, who is not the carrier, has taken possession of the goods.

To exercise your right of withdrawal, you must inform us (ekovita a project of [your company name], [your address], E-Mail: [your email address]) by means of a clear statement (e.g., by post or email) of your decision to withdraw from this contract.

To meet the withdrawal deadline, it is sufficient for you to send the notification of the exercise of the right of withdrawal before the withdrawal period expires.


Consequences of Withdrawal

If you withdraw from this contract, we will refund to you all payments we have received from you, including delivery costs (with the exception of additional costs arising from your choice of a delivery method other than the most favorable standard delivery offered by us), without undue delay and in any event no later than fourteen days from the day on which we received notification of your withdrawal.

For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise. In no case will you be charged any fees for this repayment.

We may refuse repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier.

You must return or hand over the goods without undue delay and in any event no later than fourteen days from the day on which you inform us of the withdrawal. The deadline is met if you send the goods before the period of fourteen days has expired.

You bear the direct costs of returning the goods.

You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary to check their nature, characteristics and functionality.


Exclusion or premature expiry of the right of withdrawal

The right of withdrawal does not apply to the following contracts:

  • Delivery of goods that can spoil quickly or whose expiry date would be quickly exceeded.

The right of withdrawal expires prematurely for:

  • Delivery of sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal was removed after delivery.


Liability

The seller is unreservedly liable for damages resulting from injury to life, limb or health, as well as in cases of intent or gross negligence.

Furthermore, the seller's liability is limited to foreseeable damages typical of the contract. No liability is assumed for indirect damages and consequential damages, unless an express guarantee has been given.


Force Majeure

In the event of force majeure events (e.g. natural disasters, pandemics, strikes, official measures) that make timely contract fulfillment impossible, the seller is not liable for delays or failures.


Applicable Law & Jurisdiction

The laws of the Federal Republic of Germany apply, excluding UN sales law.

The place of jurisdiction for all disputes arising from contractual relationships is, to the extent legally permissible, the company's headquarters.
